La Fiscalía de Málaga está investigando una denuncia presentada por el PSOE por supuestas irregularidades urbanísticas en el Ayuntamiento de Alhaurín el Grande. En concreto, la portavoz socialista, Josefa Jiménez, acusa al alcalde del PP, Juan Martín Serón, y al concejal de Urbanismo, Gregorio Guerra, de conceder licencias urbanísticas que no se ajustan a la legalidad a cambio de donaciones económicas al Ayuntamiento de Alhaurín el Grande. El regidor Juan Martín Serón afirma que «todo es legal» y acusa al PSOE de utilizar a la Fiscalía en sus luchas políticas contra él.
Dos de las donaciones vinculadas a la concesión de licencias de obras con edificabilidad superior a la establecida en el Plan General de Ordenación Urbana (PGOU) que ahora el PSOE ha puesto en conocimiento de la Fiscalía ya fueron denunciadas y archivadas por un juzgado de Coín hace tres años. El alcalde se extraña de que ahora vuelvan a llevarse a la Justicia y explica que se trataba de aportaciones «legales» que eran ingresadas en el presupuesto para poder realizar obras municipales. Martín Serón asegura que en aquella época no tuvieron «más remedio que gobernar a base de decretos» porque estaban en minoría y «la oposición impedía aprobar nuevos presupuestos». La denuncia socialista se refiere también a otras donaciones «en especie» al Ayuntamiento de Alhaurín el Grande, valoradas en cerca de 140.000 euros y menciona otras aportaciones que van desde 6.000 a 23.000 euros vinculadas también a licencias, aunque no aporta datos de los supuestos beneficios que habrían obtenido los promotores de las mismas. Los socialistas detallan también en su denuncia la firma de un convenio en el año 2000 suscrito con Banesto por el cual el Ayuntamiento habría dejado de percibir suculentos beneficios en una operación que habría generado importantes plusvalías. Igualmente mencionan la concesión en marzo de 2006 de una licencia para la construcción de 11 viviendas adosadas en una parcela en la urbanización La Paca, donde, según el PGOU, sólo puede hacerse una vivienda. Para ello, según los socialistas, el Ayuntamiento suscribió previamente un convenio con la promotora por el que se cedía la edificabilidad de una parcela municipal en la misma urbanización a la parcela donde se pretendía edificar. El Consistorio percibía a cambio casi 187.000 euros y se comprometía a calificar de zona verde el suelo municipal desposeído de la edificabilidad. Los socialistas añaden que el citado convenio se condiciona a la modificación definitiva del PGOU, «del cual aún no se ha presentado siquiera el avance», y que con él se ha perjudicado al Ayuntamiento puesto que a cambio de la cesión de edificabilidad debería haber percibido no 187.000 euros, sino 841.620 euros, valor de mercado de la parcela municipal. De las numerosas supuestas irregularidades cometidas por el Ayuntamiento de Alhaurín que se mencionan en la denuncia del PSOE, el alcalde asegura que sólo han recibido un requerimiento de la Fiscalía relacionado con el convenio de la urbanización La Paca: «Nos han pedido que le facilitemos copia del expediente de licencia de obras cuya concesión se condiciona a una modificación de elementos en el PGOU», explica Martín Serón. «Todo es legal -añade- porque la licencia está condicionada a esa modificación y no se ha puesto un solo ladrillo. El PSOE está utilizando políticamente a la Fiscalía, queriendo hacer ver que hay ilegalidad donde no la hay, por eso se va a estrellar», afirma el regidor. |

Two of the donations to the concession of work licenses with building works superior to the established one in the General Plan of Ordenación Urbana (PGOU variations) that now the PSOE has made known to the Office of the public prosecutor already and were denounced and filed by a court in Coín three years ago. The mayor is surprised that now they return to Court and explains that they were “legal” contributions that were entered in the budget to be able to make municipal works. Martin Serón asserts that then, they did not have “more remedy than to govern with decrees” because they were in a minority and “the opposition prevented the approval of new budgets”.
The socialist denunciation also talks about to other donations “in species” to the City council of Alhaurín El Grande, valued near to 140,000 euros and mentions other contributions that also go from 6,000 to 23,000 in euros to licenses, although it does not provide data on the supposed benefits that the promoters of the developments would have obtained.
The Socialists also detail in their denunciation the company/signature of an agreement in year 2000 with Banesto by which the City council would have received succulent benefits in an operation that would have generated important capital gains.
Urbanization La Paca
Also they mention the concession in March of the 2006 of a license for the construction of 11 houses in a parcel in the urbanization La Paca, where, according to the PGOU, one house only can be built. For it, according to the Socialists, the City council previously described an agreement with the promoter by whom the construction permits for a municipal parcel in the same urbanization to the parcel were given up where it was intended to build. The Town Hall received in return almost 187,000 euros and it was committed to describe as green zone the municipal ground where the construction was planned. Socialists add that the mentioned agreement is conditioned to the definitive modification of the PGOU, “of which no advanced plans have been presented/displayed as a minimum”, and that they harmed the City council since in exchange for the cession of building licence it must have perceived not 187,000 euros, but 841,620 euros, which was the market value of the municipal parcel.
Although numerous supposed irregularities committed by the City council of Alhaurín are mentioned in the denunciation of the PSOE, the mayor says that they have only received a requirement from the Office of the public prosecutor related to the agreement of the urbanization La Paca: “They have requested that we facilitate copy of the file of work license whose concession is linked to a modification of elements in the PGOU”, Martin Serón explains. “Everything is legal - the license adds because is conditional to that modification and not a single brick has been laid. The PSOE is politically using the Office of the public prosecutor, wanting to make out that there is illegality where there is none, for that reason it will get nowhere”, affirms the mayor.
